If a Medicaid HCBS-supported resident of congregate residential care or a nursing facility resident whose costs are supported by Medicaid has a spouse who remains independent in the community, then the income and assets allowed to the couple exceed those suggested above. Basically, the community spouse may keep the couple’s home, an automobile, and income deemed sufficient to allow her or him to live in the house and make use of the car.
